      <title>A comment on Medical Malpractice or Complications?</title>
      <description>I don't see the reluctance in taking the case.  The real negligence was not in nicking the ereter, it was in failing to recognize the symptoms and repair the nick before the infection progressed to such an acute stage.  When a surgeon knows there is a possibility of a nick and fails to heed the warning signs -- and there were many -- that such had occurred, then you have professional negligence.  A review of the daily hospital reports I'm certain will show the doctor took this surgery for granted and failed to pay attention to the progressive signs that there was infection spreading in the abdomen.  In other words, it's not the nick that was the negligence, it was the result of the nick.</description>

All the testing now performed is in direct response to the avoidance of a lawsuit.&lt;br /&gt;I think you missed this one!&lt;br /&gt;&lt;br /&gt;When asked about lawyers in the aggregate, the public views them lessfavorably.  Lawyers' ethical standards and practices are thought to be middling by most people, with a much larger contingent regarding them as poor (21%) than as excellent (3%).20 Those who thought  &lt;br /&gt;&lt;br /&gt;[808]&lt;br /&gt;&lt;br /&gt;--------------------------------------------------------------------------------&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;lawyers less honest than most people rose from 17% in 1986, to 31% in 1993.21 The ABA poll reports that " [h]alf the public thinks that about one-third or more of lawyers are dishonest, including one in four Americans who believe that a majority of lawyers are dishonest."22 Over the past decades, general estimations of lawyers have fallen.23 In the 1993 NLJ survey, 36% of the respondents said their image of lawyers had "gotten worse" and only 8% said it had "improved."24 &lt;br /&gt;     When, in 1991, a national sample was asked to volunteer "what profession or type of worker do you trust the least," lawyers were far and away the most frequent response. Almost as many (23%) spontaneously volunteered lawyers as the next two categories (car salesman, 13%; politicians, 11%) combined.25</description>

      <title>A comment on Medical Malpractice - "Dr. Creepy" and his tattoos</title>
      <description>I totally understand this woman's point of view. I recently had bladder surgery and was shocked to find the next morning that they had shaved my entire pubic area. The nurse did a great job, I will give her that, but it was a shock none the less. To have back surgery and wake up with an alteration, though temporary, to your front would definately be bothersome. I believe the doctor was just trying to be "cute", and in all actuality, he meant nothing by it, but it was still an innapropriate action. Hopefully he learned a lesson in this one, and will change his trademark to a smiley face sticker on the back of his patients' hands.</description>

      <description>Cindy, the reports made clear that hers was a posterior incision and there was no medical reason to be in the area of the patients panti area. The point of the case that you are missing is that he had to rub and expose her private area to apply this tatoo - he also placed her in a position where she had no idea how this tatoo got there and for a significant period of time, the police and hospital were investigating reasonable concerns that she had been sexually accosted in her room while sedated. No woman should have to spend even one moment wondering if she had been raped, or touched or if she had a STD or if pictures of her with the tatoo were going to show up on the internet. How could this doctor possibly think that putting this rose tattoo (and his choice of a red rose is not just coincidence) on this area of her body could possibly "cheer her up"?? The only person he was thinking of was himself and if you think otherwise, you are terribly naive. Finally, all the hospital staff was interviewed and no one saw him put the tatoo on her. Why did he have to wait until he was alone if this was such an innocent act?</description>
